• Fitness for a particular purpose;

• Limitation of Liability

To the fullest extent permitted under Canadian law, Elocity, its directors, officers, employees, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to:

Total cumulative liability shall not exceed one hundred Canadian dollars (CAD $100), even if Elocity has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Elocity, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, losses, liabilities, damages, expenses, and costs (including reasonable legal fees) arising from:

• Your violation of any law or rights of a third party.

Your use of the Site is also governed by Elocity’s Privacy Policy, which complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws. 
By using the Site, you consent to the collection, use, and disclosure of personal information as described in the Privacy Policy. 

• Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. 

Any legal action, dispute, or proceeding arising out of or relating to these Terms shall be brought exclusively before the courts located in Toronto, Ontario, Canada, and you irrevocably consent to the jurisdiction of those courts. 

• Changes to the Terms

Elocity reserves the right to revise these Terms at any time. Changes become effective immediately upon posting. Continued use of the Site after such posting constitutes your acceptance of the updated Terms.
